Theodore
"Theo" S. Kypreos
Theo is
a shareholder of the firm who
practices in all areas of
probate and trust litigation, trust and estate administration,
guardianship law, and fiduciary litigation. He has litigated and
advised on a broad range of probate, trust, and guardianship
matters, including will and
trust contests, accounting
actions, trust reformation/termination proceedings,
contested guardianships, elective
share proceedings, homestead disputes,
exploitation litigation, and matters involving creditor claims.
Theo routinely represents both corporate and individual fiduciaries,
as well as individual heirs and charitable beneficiaries, and he has
experience at both the trial court and appellate levels.
Theo graduated with high honors from the University of Florida
College of Law, where he was elected to the Order of the Coif and
was a member of the Moot Court Team. He received his undergraduate
degree, with honors, in accounting. Within the community, Theo has served
as President of the Young Lawyers Section and currently serves on
the Board of Directors for the Palm Beach County Bar Association.
Theo is a Trustee and former member of the Board of Directors
for the Chamber of Commerce of the Palm Beaches, and is a 2006
graduate of Leadership West Palm Beach. Theo also serves on The
Florida Bar’s Probate & Trust Litigation Committee and its
Probate and Guardianship
Rules Committee, and he is a member of the University of
Florida 's Law Alumni Council.
Practice Highlights

Represented
successor trustee in appellate proceedings before the Fourth
District Court of Appeals and the Supreme Court of Florida in a
trust litigation matter concerning $1.5 million of
corporately-held real estate.

Represented corporate trustee
in obtaining judicial approval of trustee's final trust
accounting.

Represented corporate
trustee in trust litigation concerning the administration of
family trust with over $100 million in trust assets.

Represented personal
representative in successfully defending the validity of the
decedent’s Last Will and Testament against claims of undue
influence and lack of testamentary capacity.
